TERMS AND CONDITIONS OF SALE Last updated: 22 September 2026 1. SELLER INFORMATION AND SCOPE These Terms and Conditions of Sale (“Terms”) govern purchases made through www.angelacusimano.it (the “Website”). The seller is: Angela Cusimano Entrepreneur individuel – micro-entrepreneur 7 rue du Cherche-Midi 75006 Paris, France SIRET: 995 074 697 00013 Customer Service: sales@angelacusimano.it These Terms apply to purchases made through the Website by consumers acting for purposes outside their trade, business, craft or profession. By placing an order, the Customer acknowledges having read and accepted these Terms before completing the purchase. 2. PRODUCTS Angela Cusimano offers women’s footwear and any other products or accessories presented on the Website. The essential characteristics of each product are described on the relevant product page. Product photographs and images are provided for illustrative purposes. Slight variations in colour, finish or appearance may result from screen settings or, where applicable, from the handcrafted nature of the production and materials used, without affecting the conformity of the product with its description. Products are offered subject to availability. 3. PRICES The prices applicable are those displayed on the Website at the time the order is placed. Prices are stated in euros (€), including applicable taxes where required. Any delivery charges and other costs applicable to the order are communicated to the Customer before the order is confirmed and payment is made. For deliveries outside the European Union, customs duties, import taxes or other charges may be imposed by the authorities of the destination country. Where these charges are not included in the price displayed at checkout, they remain the responsibility of the Customer. 4. ORDERS AND FORMATION OF THE CONTRACT To place an order, the Customer selects the desired products, adds them to the shopping bag and follows the checkout process displayed on the Website. Before confirming the order, the Customer is given the opportunity to review the products selected, prices, applicable charges and information provided, and to correct any errors. Final confirmation of the order entails an obligation to pay. Following the order, the Customer receives confirmation at the email address provided during checkout. Angela Cusimano reserves the right to refuse or cancel an order where there is a legitimate reason to do so, including product unavailability, an obvious error concerning the price or product characteristics, inability to authorise payment, suspected fraud or manifestly incorrect information supplied by the Customer. If an order that has already been paid for is cancelled, the amounts paid will be refunded using the original payment method, unless otherwise agreed with the Customer. 5. PAYMENT Payment must be made using one of the payment methods offered during checkout. Orders are processed following successful payment authorisation, unless otherwise stated on the Website. Payments may be processed by authorised third-party payment service providers in accordance with their own terms and security policies. Angela Cusimano does not directly retain complete payment card details where such information is processed by authorised payment service providers. 6. SHIPPING AND DELIVERY Products are delivered to the address provided by the Customer when placing the order. Available destinations, delivery methods, applicable charges and the estimated delivery date or period are communicated during the purchasing process before the order is confirmed. The Customer is responsible for providing an accurate and complete delivery address. Where delivery cannot be completed because the Customer supplied incorrect or incomplete information, the reasonable cost of a new shipment may be charged to the Customer where permitted by law. Risk of loss or damage passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the products, in accordance with applicable law. 7. RIGHT OF WITHDRAWAL Subject to the exceptions provided by law, a consumer has fourteen (14) days from receipt of the product to exercise the right of withdrawal without giving any reason. Where several products forming part of the same order are delivered separately, the withdrawal period runs from receipt of the last product. To exercise the right of withdrawal, the Customer must communicate a clear and unequivocal decision to withdraw before the expiry of the 14-day period by contacting: sales@angelacusimano.it The Customer may use the model withdrawal form included at the end of these Terms, although use of the form is not mandatory. Merely returning a product without previously making an unequivocal statement of withdrawal does not in itself constitute valid exercise of the right of withdrawal. 8. RETURNS After notifying Angela Cusimano of the decision to withdraw, the Customer must return the product without undue delay and no later than fourteen (14) days from the date on which the withdrawal was communicated. Unless otherwise stated, and except where a product is defective or non-conforming, the direct cost of returning the product is borne by the Customer. Before sending a return, the Customer should contact sales@angelacusimano.it to obtain the applicable return instructions and return address. The Customer is liable only for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning. Footwear should therefore be tried on a clean, soft surface and handled with appropriate care to avoid unnecessary deterioration. 9. REFUNDS Where the right of withdrawal is validly exercised, Angela Cusimano will reimburse the payments received in respect of the purchase concerned, including the cost of the least expensive standard delivery method offered, where required by law. Any additional delivery costs resulting from the Customer choosing a delivery method other than the least expensive standard delivery method offered will not be reimbursed. The refund will be made without undue delay and no later than fourteen (14) days from the date on which Angela Cusimano is informed of the Customer’s decision to withdraw. Angela Cusimano may withhold reimbursement until the returned product has been received or until the Customer provides evidence that the product has been sent back, whichever occurs first. The refund will be made using the same payment method used for the original transaction, unless expressly agreed otherwise with the Customer. 10. PERSONALISED PRODUCTS In accordance with applicable law, the right of withdrawal may not apply to products made to the Customer’s specifications or clearly personalised. Where a product falls within this exception, the Customer will be informed before completing the purchase. This exception does not affect the Customer’s statutory rights in relation to defective or non-conforming products. 11. STATUTORY WARRANTIES Products sold by Angela Cusimano benefit from the statutory warranties provided under applicable French law, including the legal guarantee of conformity and the legal warranty against hidden defects. Under the French legal guarantee of conformity, the professional seller is responsible for defects in conformity appearing within two years from delivery of the product, subject to the conditions laid down by the French Consumer Code. Where a product is not in conformity, the Customer is entitled to the remedies provided by applicable law, which may include repair or replacement and, where the legal conditions are met, a reduction in price or termination of the contract. The legal guarantee of conformity applies independently of any commercial warranty that may be offered. The Customer also benefits from the legal warranty against hidden defects under Articles 1641 et seq. of the French Civil Code, subject to the applicable legal conditions. Nothing in these Terms limits or excludes any mandatory statutory rights available to consumers. 12. USE AND CARE OF PRODUCTS Customers should use, handle and care for products in a manner appropriate to their nature and in accordance with any care instructions provided. Normal wear and tear, damage resulting from misuse, negligence, inadequate care, accidents or use inconsistent with the nature of the product does not in itself constitute a lack of conformity attributable to the seller, without prejudice to the Customer’s mandatory statutory rights. 13. PROMOTIONAL CODES AND OFFERS Any promotional codes, vouchers or special offers are subject to the conditions communicated in connection with the relevant promotion. Unless otherwise stated, promotional codes cannot be exchanged for cash and cannot be used after their expiry date. Promotional offers do not affect the Customer’s statutory rights. 14. CUSTOMER SERVICE AND COMPLAINTS For enquiries concerning orders, payments, deliveries, returns, refunds, products or complaints, Customers may contact: sales@angelacusimano.it Angela Cusimano will examine complaints and seek an amicable solution where possible. 15. PERSONAL DATA Personal data collected in connection with purchases made through the Website is processed in accordance with applicable data protection law and the Privacy Policy available on the Website. 17. INTELLECTUAL PROPERTY The Website and its contents, including trademarks, logos, photographs, images, text, graphics, designs and creative content, are protected by applicable intellectual property laws. Unless prior authorisation has been obtained or use is permitted by law, such content may not be reproduced, distributed, modified or used for commercial purposes. 18. GOVERNING LAW AND CONSUMER RIGHTS These Terms and contracts of sale concluded through the Website are governed by French law. This choice of law does not deprive a consumer of any mandatory protection afforded by the law of the country in which the consumer has their habitual residence where such provisions apply under applicable conflict-of-law rules. The parties are encouraged, where possible, to seek an amicable resolution before initiating court proceedings, without prejudice to the Customer’s right to bring proceedings before a competent court. 19. CHANGES TO THESE TERMS Angela Cusimano may update these Terms when necessary. The version applicable to a purchase is the version in force at the time the Customer places the order, subject to any mandatory provisions of applicable law. 20. MODEL WITHDRAWAL FORM This form may be used by a Customer wishing to exercise the right of withdrawal. The Customer may instead make any other clear and unequivocal statement expressing the decision to withdraw.
